This In-Product Cookie Policy ("Policy") is published by Cybersharp Technology LLP, a limited liability partnership incorporated under the laws of India, trading as Chatzy AI ("Chatzy", "we", "us", or "our"), with its registered office in Delhi, India and corporate office at A-17, First Floor, Sector 65, Noida, UP - 201301, India.

This Policy explains how and when Chatzy uses cookies and similar tracking technologies (collectively, "Cookies") within the Chatzy AI software-as-a-service platform (the "Services"), accessible at https://www.chatzy.ai.

This Policy applies specifically to Cookies used within the Services (i.e., within the product experience after login). It does not govern Cookies used on the Chatzy marketing website at www.chatzy.ai, which are covered by the separate Website Privacy Policy available at https://www.chatzy.ai/#privacy.

This Policy is subject to change at any time without prior notice. Changes take effect immediately upon publication. The current version is always available within the Services and at https://www.chatzy.ai/cookie-policy. What Is a Cookie?

A cookie is a small text file that is stored on a user's device (computer, tablet, or mobile) by a website or web application server. Cookies and related tracking technologies — including web beacons, pixel tags, local storage objects, and session identifiers (collectively referred to as "Cookies" in this Policy) — contain information that can be read by a server in the domain that placed the Cookie.

Cookies serve a variety of functions, from enabling core security and authentication features to helping us understand how the Services are used. Chatzy may also automatically receive and record information from your browser or device when you use the Services, including browser type, device type, operating system, IP address, and session duration.

Why Chatzy Uses Cookies

Chatzy uses Cookies within the Services for the following purposes:

  1. 1Authentication and Security: To identify authenticated users, maintain secure sessions, prevent unauthorised access, and detect and mitigate fraudulent or abusive behaviour on the platform.
  2. 2Platform Functionality: To remember user preferences, settings, and configurations, enabling a personalised and consistent user experience across sessions.
  3. 3Performance and Stability: To monitor platform performance, detect errors, manage load balancing, and ensure the reliability and availability of the Services.
  4. 4Analytics and Usage Insights: To understand how users interact with the Services, which features are used, and how the Services can be improved. Analytics data is collected in aggregated form and is not used to identify individual users personally.
  5. 5Fraud Prevention and Abuse Detection: To uniquely identify browsers and devices for the purpose of detecting and preventing platform abuse, credential stuffing, and bot activity.
  6. 6Payment Processing: To support secure payment infrastructure, including fraud prevention in connection with billing and subscription management.

Chatzy uses Cookie data solely to provide and improve the Services. Chatzy does not use Cookie data to identify Customer End-Users personally, to sell data to third parties, or for any purpose unrelated to the operation and improvement of the Services. Chatzy does not serve third-party advertising through the in-product Services.

Categories of Cookies Used in the Services

Chatzy's in-product Cookies fall within three categories described below. The category determines whether the Cookie is essential to the operation of the Services or whether it serves an ancillary purpose for which greater user control is available.

End-User Cookies in Customer Deployments

If you are a Chatzy Customer using the Services to deploy AI agents or chatbot interfaces that interact with your own customers ("End-Users"), Chatzy may place Cookies on End-Users' browsers during such interactions. The specific Cookies placed in End-User browsers will depend on the features, integrations, and configurations you have enabled within your deployment.

6.1Customer's Consent Obligations

As the entity deploying the Services to End-Users, you (the Customer) are solely responsible for:

  1. 1Ensuring that adequate notice of Cookie use is provided to End-Users in your own privacy notices, cookie policies, and consent mechanisms;
  2. 2Obtaining all necessary consents from End-Users for the placement of non-essential Cookies in jurisdictions where consent is required by applicable law (including the DPDPA 2023 and other applicable data protection or e-privacy regulations);
  3. 3Maintaining records of End-User consents and honouring End-User requests to withdraw consent or opt out of non-essential Cookies; and
  4. 4Ensuring that your use of Cookie data collected from End-Users complies with all applicable data protection and privacy laws.

6.2Chatzy's Role

Chatzy acts as a data processor with respect to End-User Cookie data collected in the context of Customer deployments, processing such data only on Customer's instructions and in accordance with the applicable Data Processing Agreement. Chatzy is not responsible for your compliance with End-User consent obligations.

6.3Session vs Persistent Cookies in End-User Interactions

Session cookies placed on End-Users' browsers will be deleted when the End-User closes their browser. Persistent cookies will remain on the End-User's device until they expire or are deleted. The duration of specific Cookies is set out in the Cookie Register in Section 5.

Managing and Disabling Cookies

Users have a degree of control over Cookies through their browser settings. However, please note the following important limitations:

7.1Essential Cookies Cannot Be Disabled Without Impairing Service

Essential Cookies (as defined in Section 4) are strictly necessary for the operation of the Services. If you disable these Cookies through your browser settings, the Services may not function correctly or at all. Chatzy shall have no liability for any impairment to or unavailability of the Services resulting from a user's decision to disable Essential Cookies.

Where Chatzy makes an in-product cookie preference centre available, users may manage non-essential Cookie consent through that interface. Chatzy reserves the right to determine what preferences are available and which Cookie categories require consent based on the user's jurisdiction.

Legal Basis and Data Protection

8.1Legal Basis for Processing

Chatzy processes Cookie data on the following legal bases, depending on the type of Cookie:

  1. 1Essential Cookies: Processed on the basis of Chatzy's legitimate interests in maintaining the security, integrity, and functionality of the Services, and as strictly necessary for the performance of the contract between Chatzy and the Customer.
  2. 2Performance / Analytics Cookies: Processed on the basis of Chatzy's legitimate interests in improving the Services and platform performance, subject to applicable data protection law requirements regarding consent.
  3. 3Functionality Cookies: Processed on the basis of Chatzy's legitimate interests and, where applicable, with user consent.

8.2Data Minimisation

Chatzy collects only the Cookie data that is necessary for the stated purpose of each Cookie. Cookie data is not used to build personal profiles of individual End-Users or to enable targeted advertising.

8.3Third-Party Processors

Where Chatzy uses third-party service providers that place Cookies in connection with the Services (as listed in Section 5), such providers act as sub-processors or independent data controllers, as applicable. Chatzy has contractual data protection obligations in place with each such provider. Customers are encouraged to review the privacy policies of the relevant third parties for further information on their data handling practices.

8.4Retention

Cookie data is retained for the duration set out in the Cookie Register in Section 5. Where Cookie data is incorporated into aggregated analytics, it may be retained in anonymised form for longer periods for platform improvement purposes.

8.5Cross-Border Transfers

Some of the third-party providers listed in Section 5 are located outside India. Where Cookie data is transferred to such providers, Chatzy ensures that appropriate safeguards are in place in accordance with applicable data protection law.

8.6Your Rights

Depending on your jurisdiction, you may have rights with respect to your personal data, including rights of access, correction, erasure, restriction, and objection. To exercise any such rights, please contact legal@chatzy.ai. Please note that exercising certain rights (for example, requesting erasure of Essential Cookie data) may impair your ability to use the Services.

Disclaimer and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: Chatzy expressly excludes liability for any inaccuracy, error, or omission in this Policy. If you identify a discrepancy between this Policy and Chatzy's actual Cookie practices, please report it immediately to legal@chatzy.ai. Chatzy shall not be liable for any loss, damage, or inconvenience arising from a user's decision to disable or restrict Cookies, including any resulting impairment to or unavailability of the Services. Chatzy shall not be liable for the Cookie practices of third-party service providers. The limitations of liability set out in the applicable Governing Agreement apply equally to this Policy and are incorporated herein by reference.
